Neither we, our employees, agents, sub contractors or any member of the Bamboo Asset
Management shall be liable for any losses, costs, damages, liabilities or expenses
suffered or suffered by you under these Terms (including without limitation any
loss that may arise directly or indirectly from your inability to access the Services
for any reason or for any delay in, or the failure of, the transmission or receipt
of any appraisals sent to us through any electronic medium) except where caused
directly by the negligence, willful default, fraud or breach of the Terms by us
or our employees, agents, sub contractors or any Bamboo Asset Management company.
This clause is entered into by us as trustee for our employees, agents, sub contractors
and Bamboo Asset Management.
Nothing in these Terms shall limit or exclude our liability for personal injury
or death caused by our negligence.
We shall not be liable to you for any indirect losses which you suffer, except in
the case of our wilful default or fraud. “Indirect loss” would include, for example,
loss of profit, loss of opportunity, loss of business and any other indirect losses.
You will be responsible for any reasonable losses, costs, liabilities or expenses
which we incur in connection with the Services or these Terms unless caused by our
breach of the Terms, negligence, wilful default or fraud.
We shall not be liable to you in any manner or be deemed to be in breach of any
contract for the Services because of any delay in performing or any failure to perform
any of our obligations due to any circumstances beyond our reasonable control.
We can change, amend, supplement or delete any part of these Terms.
We will give you notice of any change made and will give that notice by any one
or more of the following methods:
(a) emailing you;
(b) posting a message on our website;
(c) posting a message within the secure area of your online Account;
